South Dakota Flat Fee MLS
Negative icon Limits choice of brokerage services
Positive icon Allows brokers to offer rebates to consumers

South Dakota law requires real estate brokers to present written offers to and from the client in a timely manner, even if consumers do not wish to buy these services.

In response to a U.S. Department of Justice investigation, the South Dakota Real Estate Commission unanimously voted to repeal two previous Declaratory Rulings that prohibited real estate brokers from paying rebates to customers. Because of the South Dakota Real Estate Commission’s action, consumers in that state may now benefit from increased price competition in the form of consumer rebates.
